CODE OF ETHICS

The Talent Managers Association (TMA), incorporated in 1956, is a Not-for-Profit Mutual Benefit Corporation, an association of professional Talent Managers who have shown themselves to be ethical, knowledgeable, and skilled as a talent, artist, literary, or music manager and has thus been accepted as such by their peers. 

The TMA is a self-regulating organization that stands for ethics and integrity in the field of Talent Management. By receiving membership approval by the TMA, a Talent Manager agree to adheres to and abide by the established Code of Ethics mutual to the TMA. Violation of the Code may result in disciplinary action by the TMA, under terms and conditions described in the TMA Bylaws.

  1. TMA Members shall be compensated by their Clients on a commission-only basis and no retainer fees shall be charged to or received from their Clients for any other purpose;

  2. With the exception of reimbursement for monies advanced, no fee may be charged or collected at the expense of any signed client by any TMA Member for the following reasons:

    • ​Registering or listing Clients on websites or any other publication or listing; ​​​

    • Fees for acting classes, coaching, photography/headshots, office expenses, subscriptions or similar activities;

    • Fees for publicity, film clips, videos, or any other advance or administrative fee.

  3. TMA Members agree to follow the Krekorian Talent Act wherever applicable;

  4. Commissions charged by TMA Members shall not exceed fifteen percent (15%) of the Client's gross income from the areas of film, television, live theatre, publishing, licensing, merchandising, commercials, industrials, live performance, personal appearances and/or any other related fields of the Entertainment Industry, except for the areas covered by Music and Modeling, in which case commissions may not exceed twenty percent (20%) of the Client's gross income;

  5. The terms of a TMA Member's Personal Talent Management Contract shall not exceed three (3) years, except in the field of Music, where terms shall not exceed five (5) years;

  6. No TMA Member shall knowingly induce or solicit a client to leave another Member of the TMA;

  7. No TMA Member shall hold a talent agency license, an employment agency license, or advertise themselves as a licensed Talent Agent;

  8. No TMA Member shall engage in any fraudulent or felonious activity; 

  9. No TMA Member shall refuse to represent any Client on the basis of race, color, creed, sex, age, religion, disability, natural origin or sexual preference;

  10. No TMA Member shall make false or misleading representations of a Client or other individual regarding the nature or extent of their ability to accomplish career goals;

  11. TMA Members agree to abide by all labor and state laws, and permits when working with minors.
